Hadley files lawsuit against North Shore

A gadfly resident of North Shore Towers who had a libel suit unsuccessfully brought against him by the general manager of the Floral Park co-op has filed a $750,000 countersuit.

Fred Hadley, a 30-year resident of a rent-stabilized apartment in the co-op, is suing North Shore Towers General Manager Glen Kotowski, claiming that Kotowski defamed him and caused the co-op not to renew his $36,000-a-year contract as its videographer.

Hadley publishes an Internet newsletter that at times has accused Kotowski of failing to understand fire safety in high-rise buildings and forcing workers who disagreed with him to resign or be fired.

But Kotowski’s suit, which was filed in January 2005 and sought $500,000 in damages, was thrown out of Queens Supreme Court last year on the grounds that the complaint was insufficient.

Hadley has now decided to countersue for $36,000 a year in lost wages dating back to 2003, when his contract was not renewed, and $500,000 for defamation.

Kotowski’s attorney, Errol Brett, declined to speak about the countersuit.

“Glen and I do our talking before a jury,” Brett said.

Hadley’s suit contends that Kotowski told a meeting of about 300 North Shore Towers residents in 2004 that Hadley “is not concerned about your safety É not concerned about the share values of your apartments because he’s a renter and not an owner É He is a disgruntled subcontractor who worked for North Shore Towers, his contract was not renewed and ever since then he is trying his best to discredit management.”

Hadley had been in negotiations with the co-op to renew his contract to videotape North Shore Towers events when Kotowski told the co-op that Hadley’s attitude was “unworkmanlike,” the suit alleges.

“Had (Kotowski) not improperly mischaracterized (Hadley), then North Shore Towers would have entered into additional contracts,” the suit said.

Hadley said in a phone interview that he was attempting to get Brett barred from representing Kotowski because the attorney was a witness to some of Kotowski’s statements and also because he is the lawyer for North Shore Towers, which he claimed constitutes a conflict of interest.

This Tuesday, March 27, 05:00 to 09:00 pm in the SPA you will have your last chance to vote for your District I Board Representative.

I have met my opponent, Bijan Marjan, face-to-face and we have had a chance to get to know each other. I like him. He is a very nice person. I don’t think there is one ounce of personal animosity between us. And I am very pleased that that is the case. But that is not the defining issue in this Election.

What is the defining issue?

Mr. Marjan calls himself the “independent moderate candidate”. And he is certainly moderate.
But should he be?

Look at the over-all situation here at the Galaxy:

  • the multi-million dollar cost over-runs on our Repair & Renovation Projects
  • the $21,000 wooden bridges over the lakes in front of our Lobby Entrances
  • the condition of our Lobbies – cost, so far, $900 K per Lobby, either spent or committed
  • the suspension of work on our Garage
  • our financial situation after three years of R&R.

I am very moderate about many things. But I am not “moderate” about these conditions. Every million we spend is an average of $937 per unit. It’s your money and mine. I feel that our situation calls for drastic action. The results speak for themselves.

Bottom line, it’s the people in key positions who determine the success or failure of an organization. We have the wrong people in key positions here at the Galaxy. I want to change that. That’s the defining issue in this Election. And, yes, drastic change is always immoderate.

Our General Manager, Susan Fitzpatrick, is ineffective. I want to replace her with professional Management. On this I am immoderate. Our Board President, Allen Ellinger, says not a word about her. I strongly criticize him for his failure to act. Here again I am immoderate.

Our Counsel, Robert Buckalew, cost us the astounding sum of over $400,000 in one year. Other condos in our area pay counsel about $50,000. And what did we get from Mr. Buckalew? His inflammatory letter of February 8, which suppressed our freedom of speech. I want to replace Mr. Buckalew and I criticize our Board President for supporting him. Again I am immoderate.

Look at Mr. Marjan’s Campaign Program. Does he say a word about the mis-management of our R&R Projects? Does he say one word of criticism about Ms. Fitzpatrick, Mr. Ellinger, or Mr. Buckalew? I believe that Mr. Marjan honestly thinks he is independent. But, on these all-important issues, objectively speaking – is he really independent of the people in key positions who have dominated things here at the Galaxy for so long?
